Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Emotica mobile application ("App", "Service") developed and maintained by Emotica ("we", "us", "our"). By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.

1. Description of Service

Emotica is a personal wellness application designed to help users track their mood, maintain an emotional journal, listen to ambient soundscapes, and interact with sensory de-stress activities. The App operates entirely offline and stores all data locally on the user's device. Emotica does not require an account, subscription, or internet connection for its core functionality.

2. Acceptance of Terms

By using Emotica, you represent and warrant that:

  • You are at least 13 years of age. Emotica is designed specifically for users aged 13 and older.
  • You have the legal capacity to enter into a binding agreement.
  • Your use of the App will comply with all applicable local, state, national, and international laws and regulations.

3. Medical Disclaimer

Emotica is NOT a medical device. The App provides self-help and self-reflection tools only. The information, features, and utilities provided by Emotica — including mood tracking, trend charts, journal entries, soundscapes, and sensory games — are intended solely for informational and personal wellness purposes. They do not constitute:

  • Professional medical advice, diagnosis, or treatment.
  • A substitute for consultation with a qualified healthcare provider.
  • Clinical psychological or psychiatric evaluation or intervention.

If you are experiencing a mental health crisis or have concerns about your emotional well-being, please contact a licensed mental health professional, call your local emergency number, or reach out to a crisis helpline immediately. Never disregard professional medical advice or delay seeking treatment because of something you have observed in Emotica.

4. User Responsibilities

As a user of Emotica, you agree to:

  • Use the App only for its intended purpose of personal mood tracking and self-reflection.
  • Not attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the App.
  • Not attempt to exploit, disrupt, or tamper with the App's functionality or its local data storage.
  • Not redistribute, sublicense, or commercially exploit any part of the App without explicit written consent from us.
  • Take reasonable measures to protect the physical security of your device, as all data is stored locally.

5. Privacy and Data Handling

Your privacy is fundamental to Emotica. Our complete data handling practices are described in our Privacy Policy, which is incorporated into these Terms by reference. Key points include:

  • All data you enter into Emotica is stored exclusively on your device in a local SQLite database.
  • We do not collect, transmit, or store any personal data on external servers.
  • We do not use third-party analytics, advertising, or tracking SDKs.
  • You retain full ownership and control over your data at all times.

6. Intellectual Property

All rights, title, and interest in and to the Emotica App, including but not limited to the software code, user interface design, graphics, icons, audio soundscapes, animations, and all other creative elements, are and shall remain the exclusive property of Emotica and its developers.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App on your compatible mobile device for personal, non-commercial purposes, subject to these Terms.

The Emotica name, logo, and app icon are trademarks of Emotica. You may not use these marks without our prior written permission.

7. Data Ownership and Export

You retain full ownership of all mood data, journal entries, tags, and any other content you create within the App. We do not claim any ownership, license, or rights to your personal content.

The App provides built-in functionality to export your data in PDF and Excel (CSV) formats. Exported files are saved directly to your device and are entirely under your control.

8. Availability and Updates

We strive to maintain the App's availability on the Google Play Store but do not guarantee uninterrupted access to the App or its updates. We reserve the right to:

  • Modify, update, or discontinue any feature of the App at any time, with or without notice.
  • Release updated versions of the App that may change functionality, design, or system requirements.
  • Remove the App from the Google Play Store at our sole discretion.

We will make reasonable efforts to ensure that updates do not result in loss of your locally stored data. However, we recommend periodically exporting your data as a precaution.

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that:

  • The App will meet your specific requirements.
  • The App will be uninterrupted, timely, secure, or error-free.
  • The results obtained from using the App will be accurate or reliable.
  • Any defects in the App will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EMOTICA, ITS DEVELOPERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, profits, goodwill, or other intangible losses.
  • Damages arising from the use or inability to use the App.
  • Damages arising from unauthorized access to or alteration of your locally stored data.
  • Any other matter relating to the App.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (WHICH IS ZERO, AS THE APP IS FREE).

11. Indemnification

You agree to defend, indemnify, and hold harmless Emotica and its developers from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your use of and access to the App.
  • Your violation of any provision of these Terms.
  • Your violation of any third-party rights, including intellectual property rights.
  • Any claim that your use of the App caused damage to a third party.

12. Termination

You may terminate your use of Emotica at any time by uninstalling the App from your device. Upon uninstallation, all locally stored data will be permanently deleted from your device.

We may terminate or suspend your access to the App immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Emotica regarding the use of the App. These Terms supersede any prior agreements, communications, or understandings, whether oral or written, between you and Emotica regarding the App.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the App that cannot be resolved through informal negotiation shall be submitted to the exclusive jurisdiction of the courts in your jurisdiction.

16. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

For material changes that substantially affect your rights or obligations, we will make reasonable efforts to provide prominent notice through the App or on this page.
